The respondent filed the petition under Section 13(1)(i)(ia) & (iii) of the Hindu Marriage Act, 1955, for dissolution of marriage by way of a decree of divorce. 2. The appellant filed an application under Order VII Rule 11 of the Code of Civil Procedure (hereinafter referred to as 'CPC') to reject the petition, at the threshold, on the ground that all the alleged adulterers have not been made party. 3. On reading of the petition, it is evident that the decree for divorce has been sought on various grounds including cruelty, desertion and illicit relations. It is well settled that a petition in part cannot be rejected. Moreover, respondent no.2 is one of the alleged adulterer. 4. Keeping in view the aforesaid facts and discussion, no ground to interfere is made out. 5. Dismissed.
