JUSTICE JAYANT BANERJI) Heard the learned counsel for the review petitioner. 2. This petition has been filed seeking to assail an order of 8th July 2021 passed in WA No.733/2020 dismissing the Writ Appeal. The Writ Appeal was filed against an order of the learned Single Judge dismissing the Writ Petition of the petitioner which was filed challenging the award of the industrial tribunal. The industrial tribunal and its award had upheld the enquiry conducted by the department. The coordinate bench of this Court had relied upon the judgment of the Supreme Court in Divisional Controller, KSRTC (NWKRTC) Vs K.G. Mane1. It was also noticed that nearly 92 1 (2005) 3 SCC 254 - 3 - HC-KAR NC: 2025:KHC:48224-DB RP No. 49 of 2023 offence memos were issued to the appellant prior to the incident in question and minor penalties were imposed on him. The charge against the petitioner was that the appellant being the conductor of the respondent –Corporation, on 16.12.2010 when he was conducting a vehicle from Puttur to Pailar, it was intercepted by the checking squad at the Pailar stage point and it was found that appellant had failed to issue tickets to three groups of passengers causing loss to the tune of a sum of Rs.100/-. An offence memo was issued and a detailed report was submitted by the checking squad to the respondent. Domestic enquiry was initiated by issuing a charge memo dated 29.12.2010 and enquiry officer held that the charges against the appellant were proved. A penalty of dismissal from service was imposed. In the industrial dispute raised by the appellant, it was noted by the Tribunal that the appellant was examined and the witnesses of the respondent were also examined. Industrial Tribunal held that the domestic enquiry was fair and proper and the charges against the appellant were proved. - 4 - HC-KAR NC: 2025:KHC:48224-DB RP No. 49 of 2023 3. In the aforesaid facts and circumstances, we do not find that there is any error on the face of the record that would merit review of the judgment impugned. This petition is therefore dismissed.
