This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 848/2024 registered at Police Station – Telibandha (Cyber Cell) District Raipur (C.G.), for the offences punishable under Sections 318(4) & 3(5) of the BNS.
2. The prosecution, in brief, is that the present FIR dated 25/12/2024 was VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.12.11 12:08:12 +0530
2 registered on the basis of a written complaint by Mr. Bharat Bhushan Gupta. It was alleged that On 11-12-2024, at around 4:00 pm, an unknown person (Ashish Shukla) called the complainant from mobile number 9800526958 and introduced himself as a sales agent for Ultratech Cement. He gave a proforma invoice/quotation of OPC cement along with bank details to the complainant and promised to supply 3,000 bags of cement after payment. After this, Rs 8,83,500/- was transferred to Ultratech Cement's account number 60501986074 IFSC CODE MAHB0000311 on 21-12-2024 through RTGS number CNRBR52024122195734558. Even after making the payment, the unknown person (Ashish Shukla) holding the mobile number 9800526958 is not picking up calls. Upon contacting the local office of UltraTech Cement, the complainant was told that this is a fake account in the name of UltraTech Cement and complainant has been defrauded. Based on this background, an offence was registered and a charge sheet has been filed.

Learned counsel for the applicant submits that the present applicant is innocent persons and has been falsely implicated in the aforesaid case. He also submits in the present offence and is in custody despite being innocent, which is adversely affecting his mental state and violating his fundamental right to personal liberty. The applicant was not involved in the alleged crime, has not committed any fraudulent act against the complainant, and no material on record indicates that any amount was ever transferred from the complainant’s account to the applicant’s account. Even the FIR has been registered against an unknown person, and the documents filed by the respondent show that an amount of Rs.28,83,500/- was transferred by the complainant
3 through RTGS to the account of UltraTech Cement at the behest of one Ashish Shukla, holder of mobile number 9800528958, who has no connection with the applicant. It is further submitted that the applicant was illegally detained by the respondent two days prior to 21.07.2025 and was falsely shown to have been arrested on 21.07.2025, therefore, he prays for grant of regular bail to the present applicant. 4. On the other hand learned State counsel opposes the bail application of the present applicant and submits that the charge-sheet has been filed in the present case. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the submissions made by learned counsel for the parties, nature and gravity of allegation levelled against the applicant and the fact that the applicant has no previous antecedents and also considering the fact that the charge-sheet has been filed and he has been in jail since 21.07.2025 and conclusion of the trial is likely to take some time, therefore, I am inclined to grant regular bail to the present applicant. 7. Let the Applicant – Sujeet Singh, involved in Crime No. 848/2024 registered at Police Station – Telibandha (Cyber Cell) District Raipur (C.G.), for the offences punishable under Sections 318(4) & 3(5) of the BNS, be released on bail on his furnishing personal bond with two local sureties in the like sum to the satisfaction of the Court concerned with the following conditions:- (i) The applicant shall file an undertaking to the effect that he shall not seek any adjournment on the dates fixed for evidence when the witnesses are present in

In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law. (ii) The applicant shall remain present before the trial court on each date fixed, either personally or through his counsel. In case of his absence, without sufficient cause, the trial court may proceed against his under Section 269 of Bharatiya Nyaya Sanhita. (iii) In case, the applicant misuses the liberty of bail during trial and in order to secure his presence, proclamation under Section 84 of BNSS. is issued and the applicant fails to appear before the court on the date fixed in such proclamation, then, the trial court shall initiate proceedings against him, in accordance with law, under Section 209 of the Bharatiya Nyaya Sanhita. (iv) The applicant shall remain present, in person, before the trial court on the dates fixed for (i) opening of the case, (ii) framing of charge and (iii) recording of statement under Section 351 of BNSS. If in the opinion of the trial court absence of the applicant is deliberate or without sufficient cause, then it shall be open for the trial court to treat such default as abuse of liberty of bail and proceed against him in accordance with law. 8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/-
