GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... writ of Mandamus declaring that the Respondents Police have the statutory obligation to conduct the investigation by registering the Crime/ F.I.R. pursuant to the Complaint dated 16-10-2023 that makes out the clear cognizable offenses in tune with the Constitutional Principles of life, safety and legal redressal, more particularly in view of the Law declared by the Constitution Bench Judgment of the 2 Supreme Court of India in Lalitha Kumari Vs State of U.P. and it is further consequentially prayed that this Hon'ble Court may be pleased to direct the Respondents to forthwith register the F.I.R. pursuant to the said Compliant of the Petitioner dated. 16-10-2023, investigate, lay the Charge Sheet and effectively conduct prosecution.” 2. Sri S.Durga Ramachandra Rao, learned counsel for the Petitioner would submit that the Police are not taking any action on the complaint given by the Petitioner. 3. Sri V.Farooq, learned Assistant Government Pleader for Home would submit that, based on the complaint dated 16.10.2023 given by the Petitioner, preliminary enquiry was conducted and having found that the contents of the said complaint are false, the Police have not registered any case. 4. Considering the submissions made, the Writ Petition is disposed of. However, the Petitioner is at liberty to work out her remedies before the appropriate forum in accordance with law. There shall be no order as to costs.
