Court No. - 43 Case :- CRIMINAL MISC. WRIT PETITION No. - 9292 of 2025 Petitioner :- Ganesh Chandra Srivastava Respondent :- State Of Up And 2 Others Counsel for Petitioner :- Shakti Pratap Singh Counsel for Respondent :- G.A. Hon'ble Siddhartha Varma,J. Hon'ble Sandeep Jain,J. 1. Heard learned counsel for the parties. 2. Intervention Application and Compliance Affidavit filed today. Both be kept on record. 3. No one has appeared even in the revised call from the side of the petitioner. Sri Abhishek Bharti, Deputy Commissioner of Police and the Investigating Officer Sri Kamlesh Patel have appeared. Sri Kamlesh Patel has filed a compliance affidavit. From perusal of the compliance affidavit, we gather that the charge sheet has been filed. An affidavit was filed on 13.07.2025 indicating that the investigation was completed. It was stated that Rishi Kumar Srivastava and Sumit Kumar Srivastava were arrested on the 7th of July, 2025, and the 8th of July, 2025, respectively. In the affidavit dated 13.07.2025 also it had also been stated in paragraph 13 that the charge sheet had been submitted on 10.07.2025. In paragraph 16 it had been submitted that with regard to some other accused persons, investigation was still going on. 4. Today, an affidavit of compliance has been filed again by Sri Kamlesh Patel, and in paragraph 13, it has been stated that the charge sheet had already been submitted earlier by the current investigating officer. 5. In an intervention application which has been filed today by Sri Abhishek Kumar it had been stated that very maliciously the case was filed by the first informant. However, since the learned AGA stated that no charge sheet has been submitted against Sri Abhishek Kumar, no order is required to be passed on the intervention application. 6. Since the writ petition was filed for expeditious investigation and since we find that the police had already submitted the charge sheets, consider it appropriate to put an end to this case; the writ petition is accordingly disposed of and consigned to record.
