IN THE HIGH COURT OF ANDHRA PRADESH AT.AMARAVATl (Special Original Jurisdiction) PRESENT ;,-THE HONOURABLE SRI JUSTICE I MALLIKARJUNA RAO + CRIMINAL PETITION NO: 4411/2025 Order: The Criminal Petition, u/See.482 of B.N.S.S is filed on behalf of the petitioner/A3 {o grant anticipatory bail in connection with Crime No.5/2025 of Kamalapuram Police Station, YSR Kadapa District. 2. A case has-been registered against the petitioner/A3 herein and others for the offences punishable under sections 420, 465, 467, 471,130B r/w 34 of lPC. 3. The brief facts of the case are that prior to 19.09.2022 at Mandal Revenue Office, Kamalapuram, the Al along with A2 and A3 were created fake pattadar passbooks and other documents and mutated complainant agricultural land into the A3 name in the revenue records relating to survey No.645 and took crop loan of Rs.2,50,000/- from Canara Bank, Proddatur and committed cheating. After knowing the same, the complainant enquired and came to know that the accused committed cheating and forgery. Basing on the written complaint of the complainan{,. a case in Crime No.5 of 2025 registered. _-E=T= 4. Learned counsel for the Petitioner Submits that, even according to the allegations made.in the report, Al obtained a loan from the bank by submitting fake pattadar pass Books. It is submitted that Al was arrested and subsequently released on bail. It is further submitted that A3, the petitioner, is a Close relative of A1, and the case also came to be registered against A3. 5. However, as seen from the record, nO specific allegations have been made against the petitioner in connection w-lth the loan allegedly obtained by Al using fake Pattadar Pass Books. lt is also submitted that the petitioner is a woman aged about 53 years, has a permanent residence in Kadapa District, and there is no likelihood of her absconding or fleeing from the jurisdiction of the Court. 6. Learned Assistant Public Prosecutor, while OPPOSing the petitionerJs prayer, submits that the -Investigation iS St'lll ongoing. However, upon inquiry, the learned Assistant Public Prosecutor confirmed that the petitioner has no prior criminal record. 7. ln v'lewofthefaCtS and Circumstances Ofthe'CaSe, and aS the material on record does not prima facie implicate the petitioner in obta'Ining the loan from A1, this Court is inclined to grant an{icipatory bail to the petitioner/A3, subject to the following conditions: The petitioner/Al is directed to Surrender before the station House Officer concerned Within two (2) weeks from today and on such surrender, the petitioner/A3 shall be released `t`-` `` on bail on her executing a personal bond for a sum of Rs.10,000/: (Rupees ten thousand only) with one surety for a like sum to the satisfaction of the arresting poll-ce officials. After release, the petitioner/A3 shall cooperate for investigation and shall appear before the investigating offI'Cer aS and When her Presence iS required. The petitioner/A3 shall not cause any threat, inducement or promise to the prosecution witnesses. 8.
