The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to quash the entire proceedings of Case No. 1748 of 2018 (New No. 1798 of 2019) arising out of Case Crime No. 359 of 2017, under Sections 452, 323, 504, 506 of I.P.C., Police Station- Kotwali, District- Jhansi as well as cognizance / summoning order dated 26.04.2018, pending in the Court of Chief Judicial Magistrate, Jhansi. Learned counsel for the applicants submits that private opposite party no. 2 is wife of applicant no. 1 and there are matrimonial dispute between the parties decided on the basis of compromise. Some facts have wrongly been narrated in the affidavit. Learned counsel for the applicants prays that the present applicant may be dismissed as not pressed with liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof. In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
