JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioner is the sole accused in S.C.No.161/2022 pending before the IX Additional District and Sessions Judge, Bengaluru Rural District, Bengaluru. 2. Heard both sides and perused the material on record. 3. Petitioner is accused of committing the murder of his wife by stabbing with a knife, after picking a quarrel with her. 4. Charge sheet is filed for an offence punishable under Section 302 IPC. According to prosecution, CWs.1 and 16 are the eye witnesses. The trial is in progress. It is submitted by the learned High Court Government Pleader that only three witnesses are left to be examined. - 3 - HC-KAR NC: 2025:KHC:29112 CRL.P No. 9664 of 2025 Further, CW.1 examined as PW.1 is an eye witness and he has supported the case of prosecution. 5. Learned counsel for petitioner contended that the material witnesses have not supported the case of prosecution and the evidence of CW.1, examined as PW.1 cannot be believed. He contended that the petitioner is languishing in judicial custody from 16.05.2022, more than three years and therefore, by imposing any conditions he may be enlarged on bail. He further submitted that the petitioner has two minor kids and there is no one to look after them and he is the only bread winner of the family. 6. Admittedly, the trial is in progress. The evidence of the prosecution witnesses cannot be discussed in this petition. If any observation is made on the merits of the case, same may prejudice both the parties. - 4 - HC-KAR NC: 2025:KHC:29112 CRL.P No. 9664 of 2025 7. As per the learned High Court Government Pleader, only three witnesses are left to be examined. Considering the nature and gravity of the offence, since the trial is at fag end, it is not a fit case to enlarge the petitioner on bail. Trial Court is however directed to expedite the trial.
