GP FOR HOME (AP) 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 974 of 2024 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…to issue a writ or order or direction more particularly one in the nature of writ of mandamus declaring the impugned high- handed action of the respondents herein more particularly Respondent Nos. 4 and 5 and their staff in repeatedly calling the petitioners to their police station and subjecting the petitioners to harassment and mental agony and further threatening with dire consequences without there being any proceedings or reasonable cause against the petitioners and further involving in the civil disputes of the petitioners as highly illegal, arbitrary, unconstitutional, unjust and violative of Principles of Natural Justice and violative of Articles 14, 19 and 21 of the Constitution of India and against the true letter and spirit of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and against the guidelines laid down by the Hon'ble Supreme Court and against the procedure contemplated under the A.P Police Standing Orders and the Criminal Procedure Code, 1973, consequentially direct the respondents herein not to call the petitioners to their respective police station and not to interfere in their civil disputes and further not to subject them to harassment.…” 2. Sri V.Farook, learned Assistant Government Pleader for Home, on written instructions, would submit that there are several crimes registered against the 1st petitioner herein. A rowdy sheet has been opened against the 1st petitioner vide rowdy sheet No.24 on the file of Chinnaganjam P.S. The police have been keeping close watch on the movements of the 1st petitioner 4 in connection with the rowdy sheet. He would further submit that they have not interfered in the civil disputes between the parties. He would further submit that basing on the contents of the petitioners mentioned in the present petition a case has been registered at Ongole II Town P.S., against one Pavan Reddy vide Cr.No.112 of 2023 under Section 506 of IPC and Sections 3(1)(s), 3(2)(va) of SC’s & ST’s (POA) Act, on 11.07.2023. 4. Recording the same, this Writ Petition is disposed of. However, the police are directed to follow the due process of law regarding the crimes which have been registered against the petitioners. No order as to costs.
