1. At the very outset, learned counsel for the respondent/State submits that in compliance of the order dated 17/04/2025, an affidavit of Additional RAHUL JHA Digitally signed by RAHUL JHA Date: 2025.05.07 17:30:41 +0530
2 Chief Secretary, Govt. of Chhattisgarh, Department of Home (Police) has been filed, wherein it is revealed that 90% of the pensionary benefit has already been released to the petitioner, however, 10% pensionary benefit has been withheld because in the Departmental Enquiry, the petitioner has been found guilty. The inquiry report has been forwarded by the Director General of Police to the State Government. Learned counsel would submit that a decision shall be taken within a period of 30 days and after the decision of the State Govt, rest part of the pensionary benefit will be released.
2. Counsel for the petitioner has not disputed the fact that 90% of the pensionary benefit has been paid to the petitioner.
