1. Writ petitioners, fifty(50) in number, have appeared in the National Eligibility cum Entrance Test (NEET) during the year 2024 and got qualified for admission to the MBBS Course for the academic year 2024-2025. As per the first phase of allotment, notification for admission to the MBBS for the academic year 2024-2025 was issued by the Commissioner of Entrance Examination - 4th respondent on 29.08.2024. Candidates who received the allotment was required to pay fees and join the college from 30.08.2024 to 4.p.m. on 5.9.2024. It was clarified as per notification Ext.P2 that the fees for the academic year was yet to be fixed by the Self-Financing Medical Colleges, candidates were directed to provisionally pay the fees subject to the condition of paying the balance in case the fees fixed for the academic year is higher. 12269 OF 2025 10 ie., PK DAS Institute of Medical Sciences – respondent No.5 published fees structure for MBBS Course vide Ext.P3 and fees in the open merit has been shown as Rs.7,05,805/- (Rupees seven lakhs five thousand eight hundred five only) per year, special fees Rs.1,04,805/- (Rupees one lakh four thousand eight hundred five only) and hostel charges Rs.2,01,480/- (Rupees two lakhs one thousand four hundred eighty only) and from second year onwards, special fee was Rs.38,650/- (Rupees thirty eight thousand six hundred fifty only) and hostel fees Rs.1,86,360/- (Rupees one lakh eighty six thousand three hundred sixty only) subject to the fixation by the 3rd respondent ie., Fee Regulatory Committee for Medical Education in Kerala. Vide Ext.P4 dated 18.09.2024 Commissioner of Entrance Examination 4th respondent issued notification extending the last date to 24.09.2024 with final allotment to be published on

2. All the petitioners joined the 5th respondent – College paid fees as per Ext.P3. On 27.09.2024 vide Ext.P7 4th respondent published the second phase allotment and third phase allotment on 09.10.2024 vide Ext.P8. 3. On 14.10.2024 classes of first year MBBS course commenced and after four(4) months of commencement of classes, vide Ext.P9, 5th respondent issued a circular dated 17.02.2025 increasing the tuition fee for the academic year in the open merit category to Rs.8,97,000/- (Rupees eight lakhs ninety seven thousand only) per annum and special fees for the first year to Rs.1,10,045/- (Rupees one lakh ten thousand forty five only) i.e., increase of more than Rs.27%. Representation Ext.P11 was submitted to the Fee Regulatory Commission dated 24.02.2025 but of no response and later acquired knowledge of the order of 3rd respondent dated 13.02.2025 Ext.P12 which led to issuance of the circular dated

Sri.S.Sreekumar, learned Senior Counsel, submitted that as per Section 6(4) of the Kerala Professional Colleges or the Institutions (Prohibition of Capitation Fees, Regulation of Admission, Fixation of Non-Exploitative Fee and Other Measures to Ensure Equity and Excellence in Professional Education) Act, 2006, Fees Regulatory Committee shall have the power to require each unaided professional college or institution to place before the committee the proposed fee structure of such college or institution with all relevant documents and books of accounts for scrutiny well in advance of the commencement of the academic year i.e., not later than 31st December of previous academic year. Therefore, the admissions done without approval was a lapse on the part of the College, the burden of heavy fees could not be fastened upon the students. 2025:KER:27821 WP(C) NO. 12269 OF 2025 13

The 5th respondent – college did not give any necessary information to fix the fees within the time allegedly fixed by the 3rd respondent. 3rd respondent ought to have considered that with increase in number of seats from 150 to 200, the expenses will come down. Reliance was also laid to the letter dated 26.04.2023 Ext.P14 of the National Medical Commission Medical Assessment & Rating Board (MARB) granting the permission to increase 50 seats ie., 150 to 200 seats. 6. It was also submitted that the order under challenge is in defiance of the doctrine akin to legitimate expectation under Indian Law as there has not been consistency and predictability in decision making process. The authorities have failed to adhere to the representation without providing adequate reasons, therefore, it violates the trust reposed by the citizen in the State. The judgment in Sivanandan C.T. and Others v. High Court of Kerala
2025:KER:27821 WP(C) NO. 12269 OF 2025 14 and Others [(2024) 3 SCC 799] is also cited. 7. We have heard Sri.S.Sreekumar, learned Senior Counsel and of the view that there is no force and merit. 8.
Emphatic reliance has also been laid to the notification issued by the Government as a consequence of the order of Fees Regulatory Committee fixing the fees to show that the fees structure of other Medical Colleges is far less than the one fixed by the impugned order. We are constrained to observe that the writ court cannot assume the role of an appellate authority under the realm of powers under Article 226 of the Constitution of India as it is in the domain of the competent authority i.e., Fee Regulatory Committee constituted under the orders of Supreme Court. The Fees Regulatory Committee has taken into consideration various parameters and aspects i.e., availability of infrastructure, teaching and non-teaching staff and
2025:KER:27821 WP(C) NO. 12269 OF 2025 15 equipment, expenditure on administration and maintenance as per Section 11(e) of the Act, surplus required for growth and development of professional institutions, statement of tuition fee proposal for MBBS, statement of tuition fee computation, list of faculty members, academic program details, copy of trust deed, copy of audited financial statement of Medical College for the year 2023-2024, copy of audited financial statement of trust, copy of audit report in Form 10B for the financial year 2023-2024, copy of income tax return and total income computation statement for the assessment year 2024-2025, statement containing details of course wise, batch wise tuition fee and special fee provisional and audited, statement containing details of course wise, batch wise Hostel/mess fees, statement of expenditure, loan sanction letter, letter of permission from National Medical Commission, Affiliation order, Minimum Standard requirement etc.. The contention that increase of

The aforementioned chart reveals that the consumer price index, additional revenue expenses, over dependence on banks for loans and advances, consequent debt-servicing expenditure and capital investment to increase the admission capacity to 200 seats are the factors which led to the precarious situation of mounting deficits and therefore, while undertaking the exercise of regulating the fees, due regard had been to the mandate of law on the subject as per the provisions of Section 11(2) of the Act. Written Down Value of the investment in building and the road used by the college had also been one of the factors. All these factors if looked into cumulative, we are of the view that the findings of fact and law arrived at by the Fee Regulatory Committee manned by the expert committee is in consonance with the provisions of the Act referred to above and cannot be said to be unfair, unpredictable and against the doctrine of legitimate expectation as per the
