GP FOR SERVICES I The Court made the following: 2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY W.P.No.33843 of 2025 ORDER: The present Writ Petition is filed to declare the action of the Respondents in not considering the case of the Petitioner for promotion to the post of ‘DR GSTOs ( Direct Recruit Goods and Service Tax Officers) on the ground of pendency of Charge Memo JC (ST) file No.A1/A/2023, dated 14.03.2023 as illegal and arbitrary. 2. The Petitioner is working as Assistant Executive Officer. It is stated that now he is eligible and qualified for promotion to the post of ‘Direct Recruit Goods and Service Tax Officer’. While so, a Charge Memo stated above was issued to the Petitioner on 14.03.2023, making certain allegations. 3. It is stated that after serving the above Charge Memo, the Petitioner submitted ‘Statement of Defence’ refuting the aforesaid Charge and the enquiry is stated to be pending. 4. Learned Counsel for the Petitioner submits that the Petitioner is now due for promotion to the post of ‘Direct Recruit Goods and Service Tax Officer’, but the Respondents are refusing to consider the case of the Petitioner for promotion to the said post on the ground of pendency of disciplinary proceedings. Hence, the present Writ Petition. 5. Heard the respective counsel. 3 6. Having heard the respective submissions, this Court is of the opinion that the case of the Petitioner can be considered for promotion to the post of ‘Direct Recruit Goods and Service Tax Officer’’ in terms of G.O.Ms.No.257 General Administration (Ser.C) Department, dated 10.06.1999. 7. Accordingly, the Writ Petition is disposed of with following directions: i) The Respondents are directed to consider the Petitioner’s case for promotion to the Post of ‘Direct Recruit Goods and Service Tax Officer’ subject to the Petitioner possessing requisite qualifications in terms of G.O.Ms.No.257 General Administration (Ser.C) Department, dated 10.06.1999. (ii) There shall be no order as to costs.
