ORAL ORDER The 1st petitioner is the institution and petitioners Nos.2 to 8 are the students, who are before this Court

seeking a writ of mandamus to direct the respondents Nos.2 and 3 to generate the registration numbers of the students for D.Pharma course of the academic year 2023- 2024 and the petitioners have also sought for interim orders.
2. This Court by an interim
order dated 13.01.2025, directed respondent No.3 to permit the petitioners to appear for the annual examination which commenced from 15.01.2025 and also to enable the petitioners No.2 to 5/students to take up the practical examinations commencing from 27.01.2025.
3. During the course of these proceedings, the
learned counsel appearing for respondent No.1 submitted that in terms of Annexure-A permission was granted by the State Government to the 1st petitioner - institution, subject to the condition that the petitioner - institution will have to get approval at the hands of the Pharmacy Council of India - respondent No.1. On the next date of hearing

i.e., 05.08.2025, learned counsel for the petitioner furnished a copy of the approval granted by the Pharmacy Council of India, along with a memo.

Learned counsel for the petitioner submits that all that remains to be done by this Court is to issue directions to the respondents to announce the results of the examination already taken up by the petitioners No.2 to 5 students.

However, learned Additional Government Advocate submits that the 1st petitioner - institution was required to upload all the information on or before 30.06.2024, but the information has been uploaded by the 1st petitioner – institution on 26.12.2024. The learned Additional Government Advocate would therefore submit that the 1st Petitioner - Institution having failed to upload the requisite information within time has approached this Court and by way of interim relief, directions were issued by this Court to enable the petitioners No.2 to 5/students

to take up the examination. It is therefore submitted that the 1st petitioner-institution must be saddled with exemplary costs.

Having regard to the undisputed facts stated hereinabove and having regard to the fact that the petitioners No.2 to 5 students were permitted to take up the examination, what requires to be considered is the conduct of the 1st petitioner-institution. This Court has come across several such instances where the institutions do not follow the procedures prescribed and it is only because of the students, interim orders are passed by this Court to enable them to take up the examination. Such conduct of the 1st petitioner - institution cannot be condoned. If such petitions are allowed without addressing the issue regarding the conduct of the 1st petitioner - institution, it would amount to travesty of justice.
7. Consequently, the petition stands disposed of with a direction to the respondent authorities to announce

the results of the examinations taken up by the petitioners No.2 to 5 students. The 1st petitioner institution shall pay costs of Rs.1,00,000/- to the 3rd respondent. Acknowledgment for payment of the costs shall be filed in the office within a period of four weeks from today. The 3rd respondent is also directed to upload the registration numbers of the petitioners No.2 to 5 students.
8. Learned Additional Government Advocate is permitted to file memo of appearance within a period of four weeks from today.
