1. The application of the applicant was earlier rejected on 30.10.2020 by the trial Court. Learned counsel appearing for the applicant submits that as many as five witnesses have been examined and, in the interregnum, FSL report has also been received by the trial Court. According to him, the FSL does not justify or support the prosecution case. He, thus, contends that if the overall facts and circumstances are considered in the right perspective, it would appear that the applicant has been falsely implicated as the applicant and her mother were helping the victim. According to him, the victim was not being treated appropriately by her parents, and the earlier FIR lodged by the father of the victim would indicate that she got missing on earlier This is a digitally signed order. occasions and when she appeared, those FIRs were cancelled.
2. Bearing in mind the aforesaid facts and circumstances, the Court was of the considered opinion that the applicant should approach the trial Court by way of a fresh application which should be considered on the basis of the material available on record.
3. In view of the aforesaid, the applicant counsel, at this stage, seeks liberty to withdraw this applicant with liberty to approach trial Court. If the applicant does so, let his application be dealt with due expedition on its own merit.
4. Application stands disposed of.
