The present application u/s 528 BNSS has been filed with prayer to quash the order dated 13.2.2025 passed by the Chief Judicial Magistrate, Azamgarh in Criminal Case arising out of Case Crime No. 402 of 2024, under Sections 305, 317(2), 331(4), BNS, P.S. Mubarakpur, District Azamgarh, as well as cognizance, whereby non-bailable warrant has been issued. Learned counsel for the applicant submits that details of the case is wrongly mentioned in the prayer clause as well as application. Learned counsel for the applicants further submits that he may be permitted to withdraw the present case with liberty to file a fresh with better particulars. In view of above, the present application is dismissed as withdrawn with the aforesaid liberty. Certified copies of the relevant documents be returned to learned counsel for the applicant after retaining a photocopy of the same.
