Heard the submissions of the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the state. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as C.C. No.235 of 2024 on the file of the Court of Judicial First Class Magistrate, Bhimadolu, for the alleged offences under Sections 354A(1)(i), 354(C), 384 and 511 of the Indian Penal Code, 1860, on the complaint of the 2"'^ respondent. 3. The learned counsel further submits that the Management of the College, where the petitioner was employed as Principal, lodged a complaint alleging that the petitioner engaged in misconduct with students. Further, it is alleged that the petitioner collected a sum of Rs.5,000/- from each student under the pretense of awarding marks in the examination. Based this complaint, the police conducted an investigation and subsequently filed a charge sheet. 4. It is submitted that the complaint filed by the management is false and that the students have been used as witnesses, despite there being no truth in on the allegations. 3 CRLP.No.4457 of 2025 The learned Assistant Public Prosecutor submits that, during the course of 5. the investigation, as many as ten student witnesses given their statements before the police, leading to the filing of the charge sheet. Considering the nature of allegations and the stage of the investigation 6. carried out by the police, the issue raised by the petitioner regarding the falsity of the complaint or otherwise must be adjudicated by the trial court. This Court, without delving into the merits of the case, leaves it open to the petitioner to raise all these grounds before the trial court. Accordingly, the criminal petition is dismissed. 7.
