GP FOR REVENUE 3 HBKM,J W.P.No.11144 of 2020 The Court made the following Order: No representation for the petitioners. Heard the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondents in interfering and trying to dispossess/evict the petitioners from the landed property to the 1st petitioner having an extent of Ac.0.2800 cents situated in Sy.No.308-1 and an extent of Ac.0.3400 cents in Sy.No.308-5, the 2nd petitioner having an extent of Ac.0.7600 cents situated in Sy.No.315-7, the 3rd petitioner having an extent of Ac.0.7800 cents situated in Sy.No.315-8 and the 4th petitioner having an extent of Ac.0.1100 cents situated in Sy.No.307-1a of Moduguvalasa Village, Tekkali Mandal , Srikakulam District, for the purpose of allotting house sites to the poor persons under the scheme of Navaratnalu - Pedalandariki Illu without following the principles of natural justice and due process of law as contemplated under the Revenue laws. 3. On the other hand, the learned Assistant Government Pleader relying upon the written instructions of the 3rd respondent dated 22.09.2025 submits that there are 30 homeless poor people were identified in Bannuvada Grama Panchayat including Bannuvada, Moduguvalasa and Namballapeta Villages. On verification, for identification of the lands, an extent of Ac.0.62 cents in Sy.Nos.305 and 306 was identified in Moduguvalasa Village. As per the SFA (Settlement Fair Adangal) the lands in Sy.Nos.305 and 306 of Moduguvalasa Village are classified as “Gorja Poramboke”. Except these lands, there are no 4 HBKM,J W.P.No.11144 of 2020 Government lands available in Bannuvada and Moduguvalasa Revenue Villages. Hence, the above said land was proposed for distribution of house site pattas to the weaker sections. Some of the subject lands mentioned in this writ petition are Zeriothi lands and they were not proposed for distribution of house site pattas to the homeless poor people in Bannuvada Gram Panchayat. The petitioners encroached upon the above said Government lands and obstructed the Government officials from demarcation and the formation of layout in Sy.Nos.305 and 306, which is classified as “Gorja” poramboke of Moduguvalasa Village. As the Zeriothi shown in the above said table was not proposed for distribution of house site pattas, no orders are necessary in this writ petition with respect to those extents. However, as the petitioners are in the encroachment of Gorja Poramboke land in Sy.Nos.305 and 306 of 5 HBKM,J W.P.No.11144 of 2020 Moduguvalasa Village, if not already acted upon, the respondent Nos.2 and 3 are directed to take necessary steps to remove any encroachments in the said survey numbers for protecting the Government land in accordance with law, following the due procedure. The written instructions of the 3rd respondent dated 22.09.2025 shall be made as part of the Court record. 5. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
