JUSTICE BIBEK CHAUDHURI ORAL ORDER 3 05-08-2025 The petitioner has challenged an order of cognizance in connection with Nauhatta P.S. Case No. 76 of 2023 dated 3rd April, 2024 passed by the learned Additional Sessions Judge- VII-cum-Exclusive Special Court (POCSO), Rohtas at Sasaram, whereby and whereunder, the Special Judge took cognizance of offence under Sections 8 & 12 of the POCSO Act as well as Patna High Court CR. REV. No.502 of 2024(3) dt.05-08-2025 2/2 under Sections 341/323/504/506/34 of the Indian Penal Code and under Sections 3(i)(r)(s)/3(2)(va) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. 2. An order of cognizance being an Interlocutory Application cannot be challenged in revision under Section 397 read with Section 401 of the Cr.P.C. However, it is open for the petitioner to challenge the order of cognizance under Section 482 of the Cr.P.C. 3.
