ORDER The delay of 90 days in filing the Second Appeal is sought to be condoned. 2.I have heard Mr.V.Muruganandam learned Counsel for the petitioner and Mr.V.George Raja, learned Counsel for the contesting respondents. 3.Learned Counsel for the petitioner took me through the affidavit filed in support of the application, especially paragraph No.6. I find that the petitioner has made out sufficient cause entitling him for condonation of delay under Section 5 of the Limitation Act. 4.Though learned Counsel for the respondents would state that the delay has not been satisfactorily explained and does not fulfil the mandate of Section 5, I find from the affidavit filed in support of this petition that the petitioner has made out just and sufficient cause. Hence, I am inclined to entertain this petition. At the same time, in order to compensate the prejudice caused to the respondents, this Civil Miscellaneous Petition is allowed on payment of a cost of Rs.2,500/- to the learned Counsel for the respondents. 5.Post on 30.03.2026, “for reporting compliance”.
