order dated 16.01.2021, passed by the learned Trial Court, in terms whereof, police protection sought by the petitioners for the implementation of the interim order passed by the learned Trial Court was refused.

order passed by the Hon’ble Coordinate Bench on 24.02.2021, this Court reiterated that parties shall maintain status quo qua construction on Khasra No. 1723.
3. In light of the fact that the application for the grant of police assistance was refused by the learned Trial Court as far back as on 16.01.2021, this Court is of the considered view that this petition has lost its efficacy.

Learned counsel for the petitioners submits that day in and day out, the respondents are violating the interim order. This is strongly refuted to by the learned counsel for the respondent.

Be that as it may, without making any observation on the merit of the contention of the learned counsel, as to whether there is any violation of the interim order or not, all that this Court can observe is that this is not the Fora to rake up said issue and the party can always invoke the jurisdiction of the Court under the appropriate statutory provision qua the said issue.
6. In view of the above, this petition is disposed of
3 2025:HHC:29428 without interfering with the impugned order. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
