(ORAL) Owing to the prevailing sensitive situation, Bar Council is observing No Work Day. Seeking directions to the respondents to grant dearness allowance, washing and medical allowance (as per Govt. norms), the instant writ petition has been filed. It has been averred in the writ petition that the petitioners are serving as Heavy Passenger Transport Vehicle Drivers for more than last nine years, however, the admissible benefits in terms of the Govt. norms as well as the directions passed by the Hon’ble Supreme Court in the order dated 16.08.2022 passed in Contempt Petition (Civil) No.399 of 2020 in SLP (Civil) No.25389 of 2011 and further reiterated by a Division Bench of this RAJ KUMAR ARORA 2025.05.12 10:26 I attest to the accuracy and integrity of this document CWP-13179-2025 (O&M). -2- Court in Letters Patent Appeal No.292 of 2023 decided on 14.12.2023 titled as ‘Haryana State Legal Services Authority and others Vs. Karam Pal and others have not been granted. It is averred that the petitioners have already submitted a legal notice dated 05.02.2025 (Annexure P-6) for disbursement of the admissible benefits, however, no decision has been taken thereupon and therefore, a prayer is made for directing the respondents to pass a speaking and reasoned order in accordance with law and in a time bound manner. Taking into consideration the prayer made in the present writ petition as also the facts noticed above, I am of the opinion that issuance of a formal notice may not be necessary in the present case in view of the order which this Court proposes to pass. Accordingly, without commenting upon the merits of the case, the present writ petition is disposed of at this stage with a direction to respondent No.3-Director General, Haryana State Transport, Chandigarh, to decide the legal notice dated 17.02.2025 (Annexure P-9) submitted by the petitioners and to pass a speaking and reasoned order thereupon in accordance with law within a period of four months from the date of receipt of certified copy of this order.
