JUSTICE B M SHYAM PRASAD - 3 - HC-KAR NC: 2025:KHC:32175 WP No. 24837 of 2025 ORAL ORDER The petitioner, asserting ownership of different survey numbers in Dodderi, Grama, Tavarekere Hobli, Bengaluru South Taluk [the subject property], has sought for directions to the second respondent to register a FIR acting on the first information dated 27.05.2025 [as per Annexure - L]. Mr. T. N. Viswanatha, the learned counsel for the petitioner, submits that the petitioner has filed an application for survey with the Survey Authorities and the petitioner apprehends difficulties for the survey because his employers are brought under threat and the second respondent has not taken any action on the assistance for the survey work. When queried, Mr. T. N. Viswanatha is categorical that the Survey Authorities can indeed approach the jurisdictional police if there is any disturbance in the survey, but this Court must intervene to direct the - 4 - HC-KAR NC: 2025:KHC:32175 WP No. 24837 of 2025 second respondent to act upon the complaint of threat to life to the petitioner’s employers. Mrs. K. P. Yashodha, the learned Additional Government Advocate, who is called upon to accept notice for the respondents, is heard, and this Court is of the view that the petition must be disposed of with liberty to the petitioner to file a certified copy of this order with the second respondent insofar as the petitioner's grievance about threat to his employers, calling upon the second respondent to take appropriate action in law, while also observing that if there is any obstruction for the survey, it is for the Survey Authorities to approach the Jurisdictional Police.
