ORDER:
The instant criminal petition under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C)/under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed by the Petitioner/Accused, seeking quashment of the proceedings pending against him in S.C.No.30 of 2025 on the file of Special Judge for Trial of Offences under the SC’s & ST’s (POA) Act, Nellore for the offences punishable under Sections 351(2), 79 of BNS and Section 3(1)(r)(s)(w)(ii) and 3(2)(va) of SC’s & ST’s (POA) Amendment Act.
2. Heard Sri Kiran Tirumalasetti, learned counsel for the Petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State.

Learned counsel for the petitioner would submit that in fact, it is a civil litigation between the parties which has turned into criminal case taking advantage of the caste of the respondent No.2. He would further submit that no such incident has happened as alleged. Police have not investigated into the matter, except reiterating what is there in the complaint in the charge sheet. Learned counsel for the petitioner would submit that the petition may be
disposed of by dispensing the presence of the petitioner before the Trial Court.

4. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders.
5. Considering the submissions, the Criminal Petition is disposed of. However, the presence of the petitioner/Accused before the Trial Court is dispensed with, unless his presence is specifically directed by the Trial Court.
