Heard learned Senior Advocate appearing on behalf of petitioner and learned Standing Counsel for the State. 2. The writ petition is filed with the following prayer: "(a) a writ, order or direction of a suitable nature commanding the respondents to forthwith grant compassionate appointment to the petitioner against a post commensurate with his educational qualifications within a period to be specified by this Hon'ble Court. (b) a writ, order or direction of a suitable nature commanding the respondents to permit the petitioner to function on the post so appointed and to pay the petitioner his regular monthly salary." 3. It is submitted by learned Senior Advocate appearing on behalf of petitioner that the father of petitioner was working as Assistant Teacher in the respondent-institution and has died while in service on 24.11.2024. It is submitted by learned Senior Advocate that claim of petitioner for compassionate appointment is pending before respondent no.2. In this respect, petitioner has filed representation dated 4.2.2025 before respondent no.3, however till date, no order has been passed. Learned Senior Advocate further submits that appropriate authority in respect of compassionate appointment is respondent no.2. 4. Learned Standing Counsel submits that claim of petitioner would be decided in a time bound manner. 5. Considering the facts and circumstances of the case, it is hereby provided that respondent nos.2 or 3, Regional Joint Director of Education, Gorakhpur Region, Gorakhpur or District Inspector of Schools, Deoria shall decide the representation dated 4.2.2025 filed by petitioner in accordance with law, preferably within a period of two months from the date of production of a certified copy of the order. 6. It is clarified that this Court has not decided the issue on merits and the authorities concerned shall independently apply its mind and pass order in accordance with law. 7.
