Heard learned counsel appearing for review petitioner and learned counsel appearing for respondent No.1.
2. The petitioner has filed this review petition seeking reconsideration of the Final
Order dated
12.02.2024. The principal ground urged is that the original
order, particularly paragraph (iv) thereof, which extends the benefit of continuity of service along with all monetary and other academic benefits excluding arrears of salary is contrary to the statutory provisions governing the

promotion of academic staff under the Career Advancement Scheme (CAS) applicable to the petitioner- University. It is the specific contention of the review petitioner that promotions under the CAS are governed by detailed eligibility conditions and criteria prescribed under the relevant statute. Therefore, according to the review petitioner, the relief granted under paragraph (iv) of the final order overlooks these statutory requirements and thereby warrants reconsideration. 3. Upon a careful perusal of the review petition and the grounds urged therein, it becomes apparent that the petitioner essentially seeks to place new material on record and re-argue the matter already adjudicated by this Court. The review petitioner does not point out any error apparent on the face of the record nor does the petition demonstrate any inadvertent omission or mistake that would justify review of the final order in terms of the settled principles under Order XLVII Rule 1 of the Code of Civil Procedure, 1908. It is well settled that review

jurisdiction cannot be invoked merely because the party is dissatisfied with the reasoning or conclusion arrived at in the original order. Review is not an appeal in disguise, and a party cannot seek rehearing of the matter under the guise of review. 4. In the present case, the review petitioner is effectively attempting to re-agitate the very same issues that were raised and considered at the time of disposal of the original petition. This Court, in exercise of its review jurisdiction, cannot undertake a fresh adjudication of those issues merely because the petitioner is now bringing forth additional arguments or documents. The scope of review is confined to correcting patent errors or mistakes apparent on the face of the record, and no such case is made out herein. 5. In light of the above discussions, this Court is of the considered opinion that no ground is made out to invoke the review jurisdiction of this Court. - 5 -

The review petition is wholly devoid of merit and accordingly stands dismissed.
