2 Hon'ble Shri Justice Sanjay K. Agrawal Hon'ble Shri Justice Sachin Singh Rajput Order on Board 01/08/2025 With the consent of the parties, the matter is heard finally.
1. This writ petition is directed against impugned order dated 25/04/2024 passed in Misc. Appl. No.162/2023 by the Central Administrative Tribunal, Jabalpur Bench, Circuit Bench at Bilaspur by which the learned Tribunal dismissed the Misc. Application filed by the petitioner for restoration of Original Application. This is under challenge in this petition.
2. The petitioner’s services was dismissed by the competent authority on 24/12/2017 against which he filed an Original Application No.636/2013 which was dismissed for want of prosecution on 23/01/2017. He filed Misc. application for restoration on 14/02/2023 after a delay of 6 years alongwith application for condonation of delay showing the reason that the counsel did not appear when the case was called up and the petitioner also could not appear personally but the prayer was not considered and restoration application was dismissed by the learned Central Administrative Tribunal.
3. After hearing learned counsel for the parties and after going through the records, we find that sufficient cause has been shown for delay in filing restoration application. Accordingly, impugned order dated 25/04/2024 is hereby set aside and Original Application No.636/2013 is restored to its original number for hearing in accordance with law.
