IN THE HIGH COURT OF ANDHRA PRADESH [3311] Monday, the Thirteenth day of October, Two Thousand and Twenty Five ...Petitioner ...Respondent(s) The writ petition is filed under Article 226 of Constitution of India order or direction more particularly one in the nature of Writ of espondents in providing protection to the life and liberty of the petitioner and her husband as arbitrary and violative of Article 21 of the Constitution of India and olice authorities to provide tion to the petitioner and her husband from to pass such other order 2 BSB,J W.P.No.28205 of 2025 02. The case of the petitioner is as follows:- The petitioner has been in relationship with Kunaparaju Jagadish Varma for the past four years. After completion of the studies of the petitioner, she intended to marry him. However, her parents did not agree to her marriage and started physically and mentally harassing her. Unable to bear the harassment, the petitioner contacted Jagadish through Instagram and informed him. At the request of the petitioner, Jagadish came to the petitioner and then the petitioner left home voluntarily on 10.10.2025 and married him at Ramlaxman Kalyanamandapam, T.T.D. backside Simhachalam, Visakhapatnam district on 11.10.2025 at 8.45 a.m. The receipt of the marriage and photographs are enclosed. Now, the petitioner is living with her husband. So, the petitioner apprehends grave danger from her parents and relatives. But, the police are un-necessarily summoning the parents and relatives of the husband of the petitioner to the police station, without any formal complaint, solely under the influence of political pressure, at the behest of the parents of the writ petitioner. Hence, this writ petition is filed. 03. The learned Assistant Public Prosecutor for Home placed on record a copy of written instructions dated 13.10.2025 of the Station House Officer, Bhimavaram II Town P.S. that a case in Cr.No. 260 of 2025 was registered under section Woman missing person, basing on the complaint of the father of the petitioner dated 09.10.2025 and submitted that after filing of the writ petition, since they came to know about the status of the dispute, appropriate steps will be taken. He further submitted that the allegations in the petition are false. 04. In reply, the learned counsel for the petitioner submitted that the parents-in-law of the petitioner are being summoned to the police station and they are made to sit in the police station and that the petitioner is 3 BSB,J W.P.No.28205 of 2025 being coerced to leave her husband and live with her parents and it is therefore, highly necessary to give protection by the police against the harassment by the parents of the petitioner. He further stated that since the petitioner is aged 23 years and voluntarily married Jagadish, the petitioner seeks protection. 05. After perusal of the record, and as the petitioner is aged about 23 years and the defacto complainant also reported that his daughter is aged about 24 years as can be seen from the copy of the F.I.R., this Court is of the view that the petitioner needs protection from her parents and that the police may proceed with the investigation of the case as per law. 06. In the result, the writ petition is disposed of directing the respondents to provide the petitioner and her husband necessary protection as and when required, further giving liberty to the S.H.O. to proceed with the investigation of the case in F.I.R.No.260 of 2025, dated 09.10.2025 as per law. There shall be no orders as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition shall stand closed. ________________________ JUSTICE B.S.
