1.PUBLIC PROSECUTOR The Court made the following: ORDER: Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023^ by the Petitioner Nos.1 and 2/Accused Nos.1 and 4 for granting of pre-arrest bail in connection with Crime No.293 of 2025 of Kadiri Town Police Station, Sri Satya Sai District, registered for the alleged offences punishable under Sections 127(2), 109, 118(1) and 115(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023^. 2. Heard the learned Counsel for the Petitioners and the learned Assistant Public Prosecutor. 3.
As seen from the record, there is a delay of nearly two days in lodging the report with the police by L.W.I. The alleged offence took place 17.08.2025 at 11:45 P.M., whereas the de-facto complainant lodged the report on 19.08.2025 at 11:00 A.M. In his report, the de-facto complainant stated that after he was beaten by the accused, he went to the hospital and received treatment, and thereafter lodged the report with the police. His statement not recorded by the outpost police at the hospital. Be that as it may, there are specific overt acts attributed to Petitioner No.l/Accused No.1, alleging that he beat L.W.1 on the neck with a stick with an intention to do away with him. There are nearly nine adverse antecedents reported against Petitioner No.l/Accused No.1. Considering the gravity and serious nature of the allegations levelled against him, this Court is not inclined to grant pre-arrest bail to Petitioner No.l/Accused No.1. Hence, the petition against Petitioner No.l/Accused No.1 is dismissed. However, with regard to the allegations levelled against Petitioner No.2/Accused No.4, who is at the impressionable age of 19 years, it is merely alleged that he, along with the other accused, beat the de-facto complainant with hands and legs. Considering the nature of the allegations against Petitioner No.2/Accused No.4, the fact that no adverse antecedents reported against him, and that the wound certificate of the de-facto on was

, 3 complainant is yet to be received, this Court is inclined to grant pre-arrest bail to Petitioner No.2/Accused No.4. 6. In the result, the Criminal Petition is partly allowed with the following conditions; In the event of arrest of the Petitioner No.2/Accused No.4 he shall be enlarged on bail subject to his executing a bond for a sum of Rs.
10,000/- (Rupees Ten Thousand Only), with two sureties for the like sum each to the satisfaction of the arresting police officials; The Petitioner No.2/Accused No.4 shall make himself available for investigation as and when required; The Petitioner No.2/Accused No.4 shall not cause any threat, inducement or promise to the prosecution witnesses; The Petitioner No.2/Accused No.4 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a m. and 5.00 p.m., till filing of the charge sheet. The Petitioner No.2/Accused No.4 shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. The Petitioner No.2/Accused No.4 shall surrender his passport, if any, to the investigating officer. If he claims that they do not have a passport, he shall submit affidavits to that effect to the Investigating Officer. I.
