Earlier prayer for bail of the petitioner was rejected on merits vide order dated 20.07.2023 passed in B.A. No.4385 of 2023 and vide order dated 12.07.2024 passed in B.A. No.4125 of 2024. The petitioners- Nasim Ansari and Sarif Ansari are in custody since 07.11.2022 have renewed his prayer for bail in connection with S.T. No.54 of 2023 arising out of Garhwa P.S. Case No. 601 of 2022 for the offence registered under Sections 147, 148, 149, 341, 323, 324, 337, 307, 302 of the I.P.C. pending in the Court of learned Additional Sessions Judge-IV, Garhwa or its successour Court.. Heard the parties. It is submitted by learned counsel for the petitioner that the petitioner has renewed his prayer for bail on the ground that out of sixteen charge-sheeted witnesses, nine witnesses have already been examined and the petitioner is in custody since 07.11.2022. Learned APP for the State has vehemently opposed the prayer. It is submitted that the instant case has been filed under Sections 302 IPC and under the other sections, therefore, the custody of two years hardly makes any difference and the trial is heading towards its final stage. I do not find any change of circumstance to grant bail to the petitioner and accordingly the same is again rejected. (Gautam Kumar Choudhary, J.) Sandeep/
