Page No.# 2/2 The present application is filed for condonation of delay of 87 days in filing the connected criminal appeal assailing the judgment and order dated 07.08.2024 passed by the learned Sessions Judge, Chirang at Kajalgaon in Sessions Case No.24/2024, convicting the applicant under section 365 IPC and sentencing him to undergo RI for three years with a fine of Rs.10,000/- in default to undergo further imprisonment for three months. Mr. K K Das, learned Addl. PP submits that he has no objection, if the delay is condoned. Considering the explanation given in paragraphs 4, 5 & 6 of the connected application, this court is of the opinion that the present applicant was prevented by sufficient cause in preferring the connected appeal within time. Accordingly the delay stands condoned. I.A stands disposed of. Registry to register the connected appeal and list the same for admission on 30.01.2025, if same is not found defective.
