By way of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [“BNSS”], the petitioners seek quashing of FIR No. 154/2011 dated 24.07.2011, registered at Police Station Bharat Nagar, District North-West, Delhi, under Sections 498A and 406 of the Indian Penal Code, 1860 [“IPC”], and all proceedings arising therefrom, on the basis of a settlement arrived at between the parties. 2. Pursuant to the orders dated 08.08.2025 and 07.11.2025, respondent Nos. 2 and 3 are present in Court. 3. Respondent No. 3 submits that the Settlement Agreement dated 18.11.2023, on the basis of which the present petition has been filed, was entered into under pressure, and that she is not willing to compromise or have the proceedings quashed on the basis of the said settlement. I have enquired from Mr. Dewan Singh, learned counsel for the petitioners, whether the parties would be amenable to attempting a resolution through a fresh process of mediation. Mr. Singh, however, submits, on instructions from the petitioners, who are present in Court, that no further mediation is possible, and that the petitioners wish to withdraw the present petition and contest the matter before the learned Trial Court. 5. In view of the aforesaid, the petition, alongwith pending applications, is dismissed as withdrawn. 6. Needless to say, notwithstanding the submissions made before this Court today, in the event the petitioners and respondent Nos. 2 and 3 arrive at any further settlement, it shall be open to the petitioners to approach this Court afresh in accordance with law. 7. It is clarified that this Court has not expressed any opinion on the merits of the case or on any petition that may hereafter be filed by the petitioners, which shall be considered by the appropriate Court on its own merits and in accordance with law.
