This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending her arrest in connection with Crime No.283/2025 registered at Police Station – Purani Basti, GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.10.17 15:02:09 +0530 2 Raipur (C.G.) for the offences punishable under Sections 4,5,7 of The Immoral Traffic (Prevention) Act, 1956. 2. As per the prosecution story, on 23.07.2025, the City Superintendent of Police, Purani Basti Subdivision, Raipur received secret information that illegal prostitution activities were being carried out in a house at Professor Colony, behind Kali Mandir, Raipur. Acting on the tip, a raid was conducted in presence of witnesses, including a pointer, Ghanshyam Sen, who was given marked currency notes and instructed to signal the police after confirming the information. Upon receiving the signal, the police raided the premises and found two girls — Bharti Yadav and Neha Sahu — and one boy — Akash Sahu, along with cash, mobile phones, and used as well as sealed condoms. On interrogation, Neha Sahu and Akash Sahu disclosed that they had rented the house and were arranging prostitution activities on a commission basis, earning wrongful gain. During investigation, it was revealed that accused Krishanu Das was running a spa business under the name “Cuts and Collars” at Samta Colony, Raipur, managed by the present applicant Ahana alias Anindita Roy. It further came to light that two other spas — Blue Lagoon Spa, Katora Talab and Silk and Sign Spa, Khamhardih — were also operated under their supervision and used for similar immoral activities. The prosecution alleges that the accused persons, including the present applicant, used online job platforms such as Job Head and Work India to lure young women by offering 3 positions like beautician, telecaller, or receptionist, and thereafter induced them into prostitution for monetary gain. WhatsApp chats and photographs of different girls were also recovered from their mobile phones, indicating involvement in organized immoral trafficking. Accordingly, offences under Sections 4, 5, and 7 of the Immoral Traffic (Prevention) Act, 1956 were registered, and investigation is ongoing. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He would submit that the entire case against the applicant rests solely on the memorandum statement of co-accused Krishnanu Das and no incriminating material, evidence, or recovery has been made from the applicant connecting her with the alleged illegal activities. He would submit that the allegations in the FIR do not disclose the commission of any offence under the cited provisions of the Act. He would submit that the applicant is a lady and mother of two daughters, and her arrest would cause undue hardship to her family. Therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail. She would submit that the applicant has no criminal antecedents. 5. I have heard learned counsel for the parties and perused the material available on record. 4 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, material available on record, considering the fact that applicant has been implicated only on the basis of memorandum statement of co-accused Krishnanu Das, further the fact that the applicant has no criminal antecedents, applicant being a lady and also considering the fact that investigation and trial are likely to take some time, therefore, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Anindita Roy, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, she shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to her by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of 5 their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
