This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondents in showing only Ac.0.30 cents instead of the correct extent of Ac.0.60 cents in Survey No. 138/4 of Vatsavalasa Revenue Village, Gara Mandal, Srikakulam District, in my favour in the revenue records as illegal, arbitrary and violative of principles of natural justice, and consequently direct the respondents to correct the revenue entries and restore Ac.0.60 cents in my name in 1-B Register, Adangal, and passbook such other order or orders as this Hon'ble Court may deem fit in the circumstances of the case. 2. Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. 3. The learned counsel for the petitioner submits that the respondent authorities have shown only an extent of Ac.0.30 cents instead of the correct extent of Ac.0.60 cents in Survey No.138/4 of Vatsavalasa Revenue Village, Gara Mandal, Srikakulam District, in respect of the subject property of the petitioner, in the revenue records, which is illegal and arbitrary. Hence, the present writ petition. 4. Considering the same, this Court is of the considered view that the writ petition can be disposed of without going into the merits of the case, by giving liberty to the petitioner to make an appropriate application before the Joint Collector under Section 9 of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 within a period of one month from the date of receipt of a copy of this order. Upon such application being filed, the respondent authorities shall consider the same and pass appropriate orders based on the records, in accordance with law. 5. With the above direction the writ petition is disposed of. No order as to costs. Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed. ________________________ JUSTICE D.
