This writ petition has been filed for quashing the FIR dated 7.4.2025 bearing Case Crime no. 39 of 2025 under sections 64, 352, 351 (3) of B.N.S., P.S. Khanna, District Mahoba. Heard learned counsel for the petitioner, Sri Chandra Mani Pandey, learned counsel for respondent no. 3 and learned AGA for the State. Learned AGA informed that in this case final report has been submitted on 27.4.2025. However, he is not certain whether cognizance has been taken by the court thereon or not. Learned counsel for respondent no. 3 has no information about the filing of final report. In view of the above, the writ petition is disposed of with observation that till cognizance is taken by court on police report submitted in favour of the petitioner under Section 173(2) Cr.P.C., the respondents are restrained from arresting the petitioner in the aforesaid case crime.
