COMMON ORDER:
The Criminal Petition Nos.9128 and 9129 of 2025 have been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioners/Accused Nos.8 and 7 respectively for granting of pre-arrest bail in connection with Crime No.189 of 2024 of Narsipatnam Town Police Station, Anakapalli District, registered for the alleged offence punishable under Sections 109, 118(1) read with 3(5) of Bharatiya Nyaya Sanhita (for short ‘the BNS). 2. These two Criminal Petition Nos.9128 and 9129 of 2025 are heard and disposed of by way of this common order, as the petitioners in these petitions are accused in the same crime. 3. Heard the learned Counsel for the Petitioners and the learned Assistant Public Prosecutor. 4. The petitioners/accused Nos.7 and 8 are alleged to have committed an offence by attempting to take away the life of the victim. This Court, in Crl.P.Nos.9091, 9092, and 9093 of 2025, dated 11.09.2025, dismissed the pre-arrest bail applications filed by accused Nos.4, 5, and 6. Accused No.3 surrendered before the learned Judicial Magistrate and was subsequently enlarged on bail. According to the prosecution, there are a total of three injured persons, namely L.Ws.4 to 6, all of them sustained simple injuries. The learned Assistant Public Prosecutor submits that there are no adverse

antecedents against accused No. 8. However, accused No. 7 has two adverse antecedents. 5. Considering the facts and circumstances, the gravity and nature of the allegations levelled the petitioner/accused No.7 in Crl.P.No.9129 of 2025 and his antecedents, this Court is not inclined to grant pre-arrest bail to the petitioner/accused No.7. Hence, the request for grant of pre-arrest bail to petitioner/accused No.7 in Crl.P.No.9129 of 2025 is rejected.
However, as per the request of the learned counsel for the petitioner/accused No.7 in Crl.P.No.9129 of 2025, liberty is granted to the petitioner/accused No.7 to surrender before the learned Jurisdictional Court concerned within one (01) week from the date of receipt of copy of this order, and move an appropriate application before the learned Jurisdictional Court concerned. The learned Jurisdictional Court concerned is directed to dispose of the said application in accordance with law, on its own merits by giving due and sufficient opportunity to the learned Public Prosecutor concerned, and pass appropriate orders within a reasonable time, as far as possible preferably in two (02) days. 6. However, in view of the gravity and nature of the allegations leveled against the petitioner/accused No.8 in Crl.P.No.9128 of 2025, this Court is inclined to grant pre-arrest bail to the Petitioner/ Accused No.8 in Crl.P.No.9128 of 2025. 4
7. In the result, the Criminal Petition No.9129 of 2025 is dismissed and Criminal Petition No.9128 of 2025 is allowed with the following conditions: i. In the event of arrest of the Petitioner/ Accused No.8 in Crl.P.No.9128 of 2025, he shall be enlarged on bail subject to he executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for the like sum each to the satisfaction of the arresting police officials; ii. The Petitioner/ Accused No.8 in Crl.P.No.9128 of 2025 shall make himself available for investigation as and when required; iii. The Petitioner/ Accused No.8 in Crl.P.No.9128 of 2025 shall not cause any threat, inducement or promise to the prosecution witnesses; iv. The Petitioner/ Accused No.8 in Crl.P.No.9128 of 2025 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet.
v. The Petitioner/ Accused No.8 in Crl.P.No.9128 of 2025 shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. vi. The Petitioner/ Accused No.8 in Crl.P.No.9128 of 2025 shall surrender his passport, if any, to the investigating officer.
