Notice. Mr. L.N. Sharma, learned Additional Advocate General, appears and waives service of notice on behalf of the respondents.

This writ petition has been filed for grant of following substantive reliefs:-
“(a That the respondents may kindly be directed to grant the benefit in terms of Judgement passed in CWP 2274/2021, whereby the services of the Class IV employees are directed to be continued

- 2 - till the attaining of age of 60 years. (b) That the Respondents may be directed not to consider the Petitioner as retired at 58 years of age. (c) The Petitioner may be allowed full service and financial benefits till she reaches 60 years without any restriction of arrears of salary and other benefits at par with the benefits allowed in the Judgement Annexure P-2.”

Learned counsel appearing for the petitioner submitted that the case of the petitioner and the relief prayed for by her have already been considered & adjudicated upon by this Court in Satya Devi Vs. State of H.P. and others2. Learned counsel submits that the petitioner be permitted to prefer a representation to the respondent within a period of two weeks and thereafter the competent authority be directed to decide the said representation within a time bound schedule. Learned Additional Advocate General is not averse to this prayer.

Having regard to the afore-submissions, but without examining the merits of the matter, this writ petition is disposed of by permitting the petitioner to file a fresh comprehensive representation to the respondent/ competent authority within a period of two weeks from today. In case

- 3 - such a representation is received by the respondent within the aforesaid period, the same shall be considered and decided in accordance with law as well as taking into
consideration the above judgment in the case of Satya Devi2 within a period of six weeks from today. The decision so arrived at shall also be communicated to the petitioner.
The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
