Neutral Citation No. - 2025:AHC:74662 Court No. - 6 Case :- WRIT - A No. - 6231 of 2025 Petitioner :- Dalchand Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Anil Kumar Bind Counsel for Respondent :- C.S.C.,Kaushlesh Pratap Singh Hon'ble Saurabh Shyam Shamshery,J. 1. Heard Sri Anil Kumar Bind, learned counsel for petitioner and Sri K.P. Singh, Advocate for Respondents-2 to 4. 2. Petitioner was getting regular pension, however, it was correctly re-fixed in the year 2025 and now he has approached this Court for payment of interest on arrear of pension of Rs. 8,87,095/- non paid, from 01.01.2006 to 31.12.2015. 3. Learned counsel appearing for respondents submits that it is only a re-fixation of pension, which would not invite any interest. 4. Learned counsel for petitioner submits that petitioner’s right was infringed and it was a default on the part of respondents to re-fix pension at belated stage and paid arrears of pension belatedly, therefore, interest on delayed payment be paid. 5. I have considered the aforesaid submissions. It appears that petitioner’s pension was re-fixed and arrears between 2006 to 2015 were paid. It is also pointed out that petitioner has approached this Court earlier by way of filing Writ-A No. 1719 of 2025 raising grievance for payment of arrears and the writ petition was disposed of vide order dated 11.02.2025 since necessary order was already passed. At that stage petitioner has never argued about component of interest as well as Coordinate Bench has also not passed any direction with regard to interest. 6. In aforesaid circumstances, since petitioner has not raised grievance with regard to interest in earlier round of litigation as well as it was not mentioned in the order dated 11.02.2025 passed in earlier round of litigation, therefore, to claim interest at this stage has no legal basis. 7. The writ petition is accordingly dismissed. Order Date :- 8.5.2025 AK Digitally signed by :- AWADESH KUMAR High Court of Judicature at Allahabad
