HARISH SHIRALAKOPPA, ADVOCATE) AND: 1. CHIEF REGISTRAR OF BIRTHS AND DEATHS AND ADDITIONAL DIRECTOR DIRECTORATE OF ECONOMICS AND STATISTICS 7TH FLOOR, VISHVESHWARAYA MAIN TOWER Dr.B.R. AMBEDKAR VEEDHI, BANGALORE-560 001. 2. THE ASSISTANT DIRECTOR (STATISTIC) WEST ZONE, BIRTH AND DEATH DEPARTMENT BRUHATH BENGALURU-560 003. …RESPONDENTS (BY SRI. PAWAN KUMAR, ADVOCATE) Digitally signed by GEETHA P G Location: HIGH COURT OF KARNATAKA - 2 - HC-KAR NC: 2025:KHC:37602 WP No. 25717 of 2025 THIS PETITION IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA, PRAYING TO ISSUE WRIT IN THE NATURE OF CERTIORARI OR DIRECTIONS IN THE NATURE OF WRIT OF CERTIORARI QUASHING THE IMPUGNED ENDORSEMENT "Sanke.Sa.Ni.(Sam)Pa/Ja/Ma/PR/96/25/26" DATED 11/08/2025 ISSUED BY 2ND RESPONDENT AS FOUND AT ANNEXURE-A. THIS PETITION COMING ON FOR ORDERS, THROUGH PHYSICAL HEARING/VIDEO CONFERENCING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE M.I.ARUN ORAL ORDER The case of the petitioner is that a birth certificate has been issued by respondents- Bruhat Bengaluru Mahanagara Palike (BBMP) to his minor son Vashista M. (vide Annexure-C1 to the writ petition), wherein, name of the father (petitioner herein) has been wrongly mentioned as ‘Manu’ instead of ‘Manoj C’. Hence, he has made a request to respondents- (BBMP) to change his name. However, the BBMP has issued an endorsement at Annexure-A to the writ petition refusing to do the same. Aggrieved by the same, the present writ petition is filed with a prayer to set aside the impugned endorsement. - 3 - HC-KAR NC: 2025:KHC:37602 WP No. 25717 of 2025 2. In the course of arguments, petitioner also prays that a suitable direction may be issued to respondents-BBMP to change the name as requested. Reliance is also placed on the order of this Court in W.P.No.6370/2024 and also on the order passed in W.P.No.15937/2025. 3. Learned counsel for respondents-BBMP upon instructions fairly submits that, the writ petition may be disposed of in terms of the order passed in the aforementioned writ petitions. 4. In both the aforementioned writ petitions, it has been held that concerned authority of BBMP is required to consider the request of the petitioner by conducting necessary enquiry as per Section 15 of the Registration of Births and Deaths Act, 1969 ('the Act' for short), read with relevant Rules and pass appropriate orders in accordance with law. I do not see any reason why a similar order should not be passed in the instant writ petition also. 5. Hence, the following: - 4 - HC-KAR NC: 2025:KHC:37602 WP No. 25717 of 2025 ORDER i. The impugned endorsement dated 11.08.2025 (vide Annexure-A to the writ petition) passed by respondent no.2 is hereby set aside; ii. Respondent No.2 is directed to consider the request of the petitioner by conducting the necessary enquiry as per Section 15 of the Act read with relevant Rules and also in the light of the order passed in W.P.No.6370/2024 and pass appropriate orders accordingly; iii. The same shall be done within a period of one month from the date of receipt of certified copy of this order; iv. The writ petition stands disposed of accordingly.
