1. The petitioner has filed this petition seeking the following relief(s);-
“10.1 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to regularize/ confirm the services of the petitioner from the date of his completion of probation period. 10.2 That, this Hon'ble Court may kindly be pleased to Digitally signed by NADIM MOHLE
2 direct the respondent authorities to provide the benefit of increment and other consequential benefits and the benefit arrears thereof from the date of completion of probation period to till date. 10.3 That, this Hon'ble Court may kindly be pleased to grant any other relief as it may deems fit and appropriate.”
2. Learned counsel for the petitioner would submit that the petitioner was appointed to the post of Assistant Grade–III on compassionate grounds vide order dated 27.08.2014. He would further submit that as per the conditions mentioned in Clause 7 of the order of appointment, the petitioner was required to pass the Hindi Typing Examination and obtain a Computer Diploma from a recognised institution within a period of two years. It is further submitted that since the petitioner could not acquire the aforesaid qualifications within the stipulated period, his services have not been confirmed on the said post. He also submits that a direction may be issued to the respondent authorities to regularise his services and grant annual increments after he acquires the above-stated qualifications.
3. On the other hand, learned counsel for the respondents would oppose the submission made by counsel for the petitioner.
4. I have heard learned counsel for the parties and perused the documents placed in the file.
5. Admittedly, the petitioner was appointed to the post of AG-III on a compassionate basis on 27.08.2014, and the petitioner could not
3 acquire the required qualification according to clause -7 of the order of appointment; therefore, his services have not been confirmed, and the benefit of annual increment has also not been extended.
6. Be that as it may, if the petitioner acquires the required qualification, the respondent authorities shall consider the claim of the petitioner for regularization and for the grant of annual increment, in accordance with the law.
7. With the aforesaid observation and direction, this petition is hereby
