ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“...to issue a writ, order or direction more particularly one In the nature of WRIT OF MANDAMUS declaring the action of Respondents, particularly 5th Respondent and his subordinates at instance of Respondent No. 6 in repeatedly calling to appear before their authority and insisting us to settle the civil dispute raised by the 6th Respondent in OS. No. 11 of 2025 pending on the file of Hon’ble Principal Civil Judge Court (Senior Division) at Rajampeta, as illegal, irregular, irrational, without any authority or sanction of law and violative of Articles 14, 21 and 300- A of the Constitution of India and consequently direct the Respondents particularly 5th Respondent and his subordinates not to interfere in any manner with Petitioners personal life and liberty in connection with civil disputes except in accordance with law and pass....” 1 I I
2. Heard Sri Pala Karthi Kiran, learned counsel for the petitioners and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents. 3. Learned Assistant Government Pleader for Home for the respondents, on written instructions, would submit that two cases in Cr.Nos.167 of 2025 and 151 of 2025 under Sections 318(4) & 351(2) r/w 3(5) of BNS, against the petitioner No.3 and her husband. He would further submit that on the complaint of the petitioner No.3, on 23.12.2024, a case in Cr.No.375 of 2024 under Sections 318(4), 115(2), 61(2), 308(5), 351(2), 79 r/w 3(5) of BNS of Rajampet (U) P.S., on 23.12.2024, and the same is pending for the
T 4 examination of petitioner Nos. 1 and 2. The police could not secure petitioner Nos. 1 and 2 as they were unavailable at their residential addresses. The petitioners were called to the police station only for the purpose of such examination, since they are witnesses in Crime No. 375 of 2024, and not with any intention to harass them. Recording the above said submissions, this Writ Petition is disposed of. However, the police are directed to follow the due process of law regarding the crimes registered against the offenders.
