Heard Mr. S D Purkayastha, learned counsel for the petitioner and Mr. D P Goswami, learned Additional Public Prosecutor, Assam. This is an application filed under Section 482 of the BNSS, 2023 by petitioner, namely, Sahin Ahmed Laskar @ Sahin Uddin Laskar, seeking pre-arrest bail in connection with PRC No. 3194/2024. In a sessions triable case, the present petitioner has been shown as an absconder in the charge sheet. The petitioner submits that he intends to contest the case and has already compromised the matter with the prosecutrix. The learned counsel for the petitioner has submitted that both the sides have already compromised the matter. Under the given circumstances, the petitioner does not deserve to be detained in custody. Accordingly, the petitioner Sahin Ahmed Laskar @ Sahin Uddin Laskar is directed to appear before the court of the learned Judicial Magistrate 1st Class, Cachar, Silchar on 01.04.2025 in respect of PRC No. 3194/2024 and on his appearance, the petitioner shall be allowed to go on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned trial court. The bail application is disposed of.
