...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue a Writ, Order, or direction, more particularly one in the nature of the Writ of Mandamus, declaring the action of the Respondent Police in interfering in Civil Disputes and pressurizing the Petitioners to settle the with regard to the land ad-measuring Ac.2-82 Cents in Rs.No.33/3, Srikantapuram Village, Hindupur Mandal, Satya Sai District belonging to the First and Second Petitioners under the guise of FIR No.44 of 2023 dated
09/03/2023 and in not implementing the G.O.Ms.No.288, Home (PS and C.A2) Department, dated 06-11-2010 in its letter and spirit as illegal, arbitrary and violative of Articles 14, 19, 21 and 300-A of the Constitution of India and consequently direct the Respondent Police not to interfere with the peaceful possession and enjoyment of the Petitioners of their land and also not to pressurize the Petitioners to settle the Civil Disputes with the regard to the land ad-measuring Ac.2-82 Cents in Rs.No.33/3, Srikantapuram Village, Hindupur Mandal, Satya Sai District and pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct Respondent Police not to interfere in civil disputes by calling the Petitioners to the Police Station in respect of the Petitioners land ad- measuring Ac.2-82 Cents in Rs.No.33/3, Srikantapuram Village, Hindupur Mandal, Satya Sai District, pending the main Writ Petition, and pass Counsel for the Petitioner(S):

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue a Writ, Order, or direction, more particularly one in the nature of the Writ of Mandamus, declaring the action of the Respondent Police in interfering in Civil Disputes and pressurizing the Petitioners to settle the with regard to the land ad-measuring Ac.2-82 Cents in Rs.No.33/3, Srikantapuram Village, Hindupur Mandal, Satya Sai District belonging to the First and Second Petitioners under the guise of FIR No.44 of 2023 dated 09/03/2023 and in not implementing the G.O.Ms.No.288, Home (PS and C.A2) Department, dated 06-11- 2010 in its letter and spirit as illegal, arbitrary and violative of Articles 14, 19, 21 and 300-A of the Constitution of India and consequently direct the Respondent Police not to interfere with the peaceful possession and enjoyment of the Petitioners of their land and also not to pressurize the Petitioners to settle the Civil Disputes with the regard to the land ad-measuring Ac.2-82 Cents in Rs.No.33/3, Srikantapuram Village, Hindupur Mandal, Satya Sai District and pass.…”
2. Heard Sri MRK Chakravarthy, learned counsel for the petitioners and Sri V. Farook, learned Assistant Government Pleader for Home for the respondents.

Learned counsel for the petitioners would submit that the police are calling the petitioners to the police station, in the absence of any crime registered and interfering with the civil disputes in between the petitioners and the unofficial respondents. Learned counsel would further submit that a direction may be given to the police.
4. Learned Assistant Government Pleader for Home, on oral instructions would submit that the police are not interfering in the civil disputes between petitioners and the unofficial respondents.

Learned counsel for the petitioners would submit that recording the same, the petition may be disposed of.
6. Recording the above said submissions, the Writ Petition is disposed of. However, the police are directed not to call the petitioners to the police station since no crime has been registered against the petitioners and not to interfere in the civil disputes between the petitioners and the unofficial respondents. There shall be no order as to costs.
