PUBLIC PROSECUTOR The Court made the following; The Criminal Petition, u/Sec.480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioners/Al and A2 to grant regular bail in connection with Crime No. 125/2024 of Renigunta Railway Police Station, SPSR Nellore District. A case has been registered against the petitioners herein for the offences punishable u/Sec.20(b)(ii)(C) r/w 8(c) of NDPS Act. The case of the prosecution in nut shell is as follows; On 07.11.2024 at 6.00 am, at Renigunta Railway station platform no.5 in train no.22504 Vivelt^e^press, on receipt of credible information

Considering the submissions made and on perusal of the material on record, as rightly stated by the learned counsel for the petitioners that only on suspicion, this case has been registered against the petitioners. Nothing is found in their possession relating to the present Petitioners were in judicial custody at the time of alleged seizure of 5kgs of ganja by the police in the present case. In view of the same, this Court is inclined to allow the criminal petition with the following conditions.
In the result, the criminal petition is allowed and the petitioners/Al and A2 shall be released on bail on their executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the learned I Additional District and Sessions Judge, Nellore. After release the petitioners shall attend before the Station House Officer concerned once in a fortnight i.e. on every 2 and 4^'' Sunday in a month in between 10.00am to 01.00pm till filing of charge sheet.
