No one turns up on behalf of either of the parties in-spite of repeated calls.
Apprehending his arrest in connection with Putki (O.P. Bhagabandh) P.S. Case No.05 of 2025 instituted under Sections 303(2), 317(2), 317(5) and 3(5) of the B.N.S. 2023, Section 21 of the Mines and Minerals (Development and Regulation) Act, 1957 and Rules 7/13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage), Rules 2017, the petitioner has moved this Court for grant of privileges of anticipatory bail.
Perusal of the record reveals that the allegation against the petitioner is that petitioner is the owner-cum-driver of a pick-up van bearing registration No.JH-10CN-9098 and the said vehicle was seized by police while being involved in loading illegal coal. It is averred in the anticipatory bail application that the allegation against the petitioner is false. The petitioner has no criminal antecedent, as it appears from perusal of paragraph no.17 of the anticipatory bail application. It is also averred in the anticipatory bail application that the petitioner is ready and willing to abide by any terms and condition as imposed by this Court.
Considering the aforesaid facts of the case, I am inclined to grant privileges of anticipatory bail to the petitioner. Accordingly, the petitioner is
directed to surrender in the Court below within six weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail on depositing Rs.10,000/- as cash security and on furnishing bail bond of
Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Dhanbad in connection with Putki (O.P. Bhagabandh) P.S. Case No.05 of 2025 with the condition that he will co- operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish his mobile number and photocopy of the Aadhar Card with an undertaking he will not change his mobile number during the pendency of the case and further conditions as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
