CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR
ORAL ORDER
This petition by the sole accused in Spl.C.No.204/2021 is
directed against the impugned order dated 23.12.2024 passed by the trial court which rejected the application filed by the petitioner under Section 311 Cr.P.C. to recall the witnesses PWs 8 to 14, 18 and 24 to 27 and for cross-examination by the petitioner.
2. Heard learned counsel for the petitioner and perused the material on record.
3. A perusal of the material on record will indicate that in the aforesaid proceedings instituted by the 2nd respondent against the petitioner for offences punishable under Section 376 of IPC and Section 6 of POCSO Act, the respondent-prosecution examined as many as 27 witnesses, but were not cross-examined by the petitioner. Subsequently, the petitioner filed the instant application under Section 311 Cr.P.C. seeking to recall PWs 8 to 14, 18 and 24 to 27 and for permission to cross-examine the said witnesses,
