Order on Board 16.10.2025
1. This is an office reference.
2. This Court, vide order dated 16.08.2024 passed in MCRC No. 5801/2024, while rejecting the bail to the applicant, namely, Laxman Chhura @ Kaliya Chhura had expressed its trust that the trial Court would make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certified copy of the order, if there was no legal KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 impediment.
3. Earlier on one occasion also, this Court had granted extension of time for compliance of the order dated 16.08.2024.
4. The learned Judicial Magistrate First Class, Raipur District-Raipur (C.G.) vide its request letter dated 16.09.2025 has requested for grant of further two months time for concluding the trial.
5. It transpires from perusal of the PUD that it is most respectfully submitted that the remaining witnesses in the present case are official witnesses, including the Investigating Officer, whose presence could not be consistently secured despite repeated issuance of summons, reminders, and even bailable/non-bailable warrants. On several occasions, the witness remained unavailable owing to official exigencies, resulting in non-execution of summons within the stipulated time. The delay in recording the remaining prosecution evidence is primarily attributable to the non-availability of the Investigating Officer, who, being an official witness frequently engaged in field duties, could not appear before the Court as required. Such circumstances are beyond the control of the Court, which has been making regular and sincere efforts to expedite the proceedings. In view of the above, it is humbly prayed that a further period of two months may kindly be granted for securing the presence of the remaining prosecution witnesses and for completion of the evidence.
6. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of two months from the date of receipt of a certified copy of
3 this order, if there is no legal impediment.
7. Accordingly, this CRMP stands disposed off with the aforesaid direction.
8. Registry is directed to send a certified copy of this order be sent to the trial Court concerned for necessary information and compliance. Sd/- (Ramesh Sinha)
