This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue an appropriate writ, order or direction more in the nature of Mandamus, declaring the action of the respondents more particularly that of the respondent No.4 in directing the petitioner to come to the Police Station even after requesting for giving the reason why he was called to the police station and to furnish the necessary particulars and even without furnishing the information sought and depriving the petitioner of his personal liberty by calling him through his mobile No 93910 39037 and threatening with dire consequences and foisting of false cases, as being illegal, arbitrary and is in violation of Article 14 and 21 of the Constitution of India with a direction the respondents 2 to 4 herein not to interfere with the personal liberty of the petitioner without there being any crime registered against him” 2. Heard Sri M.Chalapathi, learned counsel for petitioner and Sri V.Farook, learned Assistant Government Pleader for Home for respondents. 3. Learned Assistant Government Pleader for Home brought to the notice of the court that a crime is registered in Cr.No.48 of 2018 for the offences punishable under Sections 447, 427, 353, 384, 323 read with 34 IPC. Learned Assistant Government Pleader further submits that in the light of the interim orders passed by this court, police are not summoning the petitioner to the police station. He further submits that, Court may pass appropriate orders. 4. As the crime is registered against the petitioner, it is apposite to dispose of the writ petition with a direction to the police to follow due process of law regarding the crime which is registered against the petitioner.
