ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused Nos.^ and 3 on bail in Crime No. 143 of 2025 of Prakash Nagar Police Station, East Godavari District, registered against the Petitioners/Accused Nos.2 and 3 herein for the offence punishable under Section 143(1), 144(2) read with 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 3(1), 4(1), 5(1 )(a) of The Immoral Traffic (Prevention) Act. Heard the learned Counsel for the Petitioners and the learned Assistant
2. Public Prosecutor. The allegation against the Petitioners/ Accused No.2 and 3, as seen
3. from the record is that they are working in the Spa Centre, wherein prostitituion has carried. Petitioner No.1/ Accused No.2 is the Manager of the Spa Centre; Petitioner No.2/ Accused No.3 is the worker in the Spa Centre. The Petitioners were arrested on 15.09.2025. They have been in judicial custody for the past 31 days. So far 7 witnesses are examined. All are official witnesses. There are no adverse criminal antecedents report against the Petitioners. Substantial portion of investigation in so far as alleged role played by the Petitioners are concerned is completed. The Petitioner No.1 is a permanent resident of Appalarajupeta, Sunrapurajupeta, East Godavari District at present residing at Lalacheruvur, Rajamahendravaram and Petitioner No.2 is a permanent resident of Devunaltada, Vajrapu Kothuru Mandal, Srirakulam District and now residing at Mangalavarapu Peta, Rajamahendravaram. They .have got fixed
abode. Chances of the Petitioners either fleeing away from the clutches from the law may not arise. Considering the nature and gravity of allegation levelled against the f Petitioners, their alleged role played ifi this case, and the period of detention undergone by the Petitioners, this Court is inclined to enlarge the Petitioners on bail with the following stringent conditions:

In the result, the Criminal Petition is allowed with the following conditions: The Petitioners/Accused Nos.2 and 3 shall be enlarged bail subject to their executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only), with two sureties each for the like sum each to the satisfaction of the learned II Additional Judicial Magistrate of First Class, Rajamahendravaram. ii.
The Petitioners/Accused Nos.2 and 3 shall appear before the Station House Officer, Prakash Nagar Police Station, East Godavari District, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court, iii. The Petitioners/Accused Nos.2 and 3 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. I. on \ The Petitioners/Accused Nos.2 and 3 shall not commit or IV. indulge in commission of any offence in future. The Petitioners/Accused Nos.2 and 3 shall cooperate with the investigating officer in further investigation of the case and shall make themselves available for interrogation by the t investigating officer as and wh^n required. The Petitioners/Accused Nios.2 and 3 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her V. VI. from disclosing such facts to the court or to any police officer. The Petitioners/Accused Nos.2 and 3 shall surrender their VII. passports, if any, to the investigating officer.
