The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.45/2025, registered at Police Station – City Kotwali, District : Raipur, (C.G.) for the offence punishable under Sections 317(2), 317(4), 317(5) and 111 of the Bharatiya Nyaya Sanhita, 2023. 2. As per the prosecution story, a Sub-Inspector of City Kotwali Police PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2025.10.16 18:37:03 +0530 2 Station in Raipur registered a cyber crime case based on a complaint received via the "Samanvay" portal, operated by the Indian Cyber Crime Coordination Centre. The complaint involved fraudulent transactions linked to 41 bank accounts in Kotak Mahindra Bank (IFSC: KKBK0006402, KKBK0006407, KKBK0006408) Raipur branch. These accounts, which began operating from January 1, 2024 to January 11, 2025, received illegal funds totalling Rs.18,96,851, suspected to be proceeds of cyber fraud. 3. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. He further submits that one Prashant had given the applicant money for share trading, and it is alleged that the total amount paid to the applicant was Rs. 51,500/-, which has already been refunded by him. He also submits that the charge-sheet has been filed and the applicant has no previous criminal antecedent, he is in jail since 12.07.2025, the trial is in progress, and it is likely to take considerable time to conclude. Therefore, he prays for the grant of bail. 4. On the other hand, the learned State Counsel opposes the bail application and submits that that the bail applications of the identically situated co-accused persons were rejected by this Court vide orders dated 16.07.2025, 24.07.2025, 01.08.2025, 08.09.2025 and 24.09.2025 passed in MCRC No. 5560/2025, 5794/2025, 6043/2025, 7151/2025 and 7557/2025, respectively. It is further submitted that the case pertains to cyber fraud, the present bail 3 application is liable to be rejected. 5. I have heard learned counsel for the parties and perused the documents available on record. 6. Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and the fact that the bail applications of the identically situated co-accused persons were rejected by this Court vide orders dated 16.07.2025, 24.07.2025, 01.08.2025, 08.09.2025 and 24.09.2025 passed in MCRC Nos. 5560/2025, 5794/2025, 6043/2025, 7151/2025 and 7557/2025, respectively and also considering the fact that the case pertains to cyber fraud, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of the applicant - Tushar Agrawal involved in Crime No.45/2025, registered at Police Station – City Kotwali, District : Raipur, (C.G.) for the offence punishable under Sections 317(2), 317(4), 317(5) and 111 of the Bharatiya Nyaya Sanhita, 2023, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
