The Court made the following ORDER: ORDER: Jrty THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 968 OF 2025 This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/Al and A2, seeking bail in Crime No.145/2024 of Kuderu Poll'ce Station, Ananthapuramu District. 2. A case has been registered initially under Section 194 BNSS and later section of law was altered to Section 108 read with 3(5) B.N.S. 3. Case of the prosecution is that husband of the informant Vadla Bhaskar Babu who was working as Head Master in M.P.P.School, Mallikethi village committed suicide in Agrigold Layout and a suicide note was found in the pocket of the deceased which discloses that the accused are responsible for his death. After registering the case, Al and A2 were arrested on 28.12.2024 and got remanded to judicial custody. 4. Heard. Perused the record. 5. Learned Assistant Public Prosecutor submits that major part of the investigation is completed except filing of charge sheet. 6. A perusal of the material available on record goes to show that the deceased had taken extreme step of committing suicide on the ground that the accused had not repaid the amount to him. ln order to attract an offence u/Sec.108 B.N.S., it is essential that all the ingredients of Section t/-==>--wl-----so I ``. \ 45 of the B.N.S. would attract. pr7'ma fac,-e, there I'S nO aCCuSatI'On to the extent that the accused had instigated or l'ntentI'Onally aided the deceased hereI'n tO take extreme step of comml'ttjng suicide. The petl-t[-oners were arrested on 28.12.2024 and sI'nCe then they are l'n judl'cI'al custody. 7. ln vl'ew of the aforesaid facts and circumstances of the case, thl's court is jncljned to grant ba" to the petjtjoners herel®n, on the following conditions.
